Physician services accessed through the Platform are provided by independently licensed physicians who are subject to the professional rules of their respective chamber (Ärztekammer) and to the applicable Berufsordnung für Ärzte.

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not currently do so voluntarily.

Liability for Content

As a service provider, we are responsible for our own content on this website in accordance with § 1 DDG (Digitale-Dienste-Gesetz) under general law. Pursuant to §§ 1 et seq. DDG and Art. 6 of the Digital Services Act (DSA, Regulation (EU) 2022/2065), we are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate unlawful activity. Obligations to remove or block the use of information under applicable general law remain unaffected. Liability in this respect is possible only from the time at which a specific legal infringement becomes known. Upon becoming aware of such infringements, we will remove the relevant content immediately.

Note on Health Data and Medical Services

The the-key.health Platform is not a certified medical device (Medizinprodukt) within the meaning of Regulation (EU) 2017/745 (MDR) or the German Medical Devices Implementation Act (MPDG). The Platform provides health data aggregation and doctor-reviewed wellness recommendations. It does not provide medical diagnoses, therapeutic prescriptions, or emergency care. In a medical emergency, call 112 immediately.

Note on Artificial Intelligence

The Platform uses an AI-based system to aggregate and present health data in a structured format (Data Analysis Report). The AI system does not generate conclusions, flag risks, rank findings, or produce recommendations. All assessments and personalised Recommendations are made exclusively by licensed physicians engaged by ACW Consulting GmbH, acting on the basis of their independent professional judgment. Accordingly, the AI system is not classified as a high-risk AI system within the meaning of Annex III of Regulation (EU) 2024/1689 (EU AI Act). This assessment is kept under review as the Platform develops and as the EU AI Act's obligations come into progressive effect.
